These Terms & Conditions govern the relationship between the American Institute of Physics (''AIP'') and employers, job posters, hiring organizations, and their recruiters, agents, employees, contractors, and representatives (collectively referred to hereinafter as "Employer") who access the Site for any reason.


The resume database is reserved for companies who are evaluating and hiring professionals for their companies. Third party agencies are not allowed to purchase resume access at this time. Our database is not intended to be used by companies and/or individuals for marketing purposes. Misuse of our Site may result in your database access being inactivated with no refund given.


AIP makes no representation or warranty of any kind concerning reliability or accuracy of information provided directly or indirectly on or through the Site. All information is provided on an "as-is" basis. Users of the Site do so at their own risk.


AIP screens ads appearing on its job boards and in the magazine Physics Today. AIP reserves the right to remove any job posting for any reason, including for noncompliance with these Terms and Conditions and the AIP Diversity Statement. If a job posting is removed (the 'Removed Posting'), AIP will determine, in its sole discretion, whether the Removed Posting may be reinstated with revisions. Employer shall cooperate with AIP in making any adjustments or revisions necessary to bring the Removed Posting into compliance with AIP's internal standards. Upon satisfactory revision, AIP may, but is not required to, reinstate the Removed Posting. If AIP determines that the Removed Posting must be removed in its entirety, AIP will provide the Employer with a prorated refund for the Removed Posting. Nothing in this section shall be construed to create any obligation or liability on the part of AIP with respect to Employer's job postings.


AIP is not responsible for the accuracy, timeliness, completeness and removal by a company of any employment information or opportunities that are placed by said company or of any resume information posted by a candidate, on the Site.


AIP makes no representation that the Site or Sites that may be linked to it are free of error. Employer must evaluate and bear all risks associated with the use of the Site and any content contained on the Site, including any reliance on accuracy, completeness or usefulness of such content. Employer understands that AIP is not for any reason responsible for any error in the transmission of information which Employer posts or receives on the Site.


By using the Site, Employer acknowledges that there are inherent risks, including without limitation the risk of violence, personal injury or other physical harm, when transacting business with unknown persons. Employer also acknowledges that AIP does not verify the identity of any individuals posting their own content on the Site and that they may not be who they purport to be or may otherwise be acting under false pretense. User content may also be inaccurate, harmful, offensive, or in violation of policies governing user content set forth in these terms and conditions. It may also be deceptively labeled. Employer agrees that it is Employer's own responsibility to exercise caution and to act prudently when using the facilities provided by the physicstoday.org website.


Employer shall not publish, transmit, or distribute or in any way use or exploit any information contained on this Site in order to obtain employees for any company other than Employer's own. Further, Employer shall not publish, transmit, or distribute or in any way use or exploit any information contained on the Site in a manner that is inconsistent with any rules, laws, or regulations of any federal, state, local authority, tribunal, or administrative agency. Employer agrees not to use the Site to transmit or otherwise make available any content that is unlawful, harmful, threatening, abusive, tortious, defamatory, invasive of another's privacy or otherwise objectionable.


By listing employment opportunities on this Site, Employer confirms that the content of its advertising is true and accurate and complies with all state, federal, and local laws, regulations, and guidelines. Employer affirms that it is an equal opportunity employer and makes all hiring decisions without regard to any characteristic protected by any law, regulation, or guideline, regardless of whether employer may have a good faith or legal basis for doing so. Employer further confirms that the listing company has all necessary authorization for the placement of the entire content of its advertising within the Site.


AIP is not liable to any candidates for any failure by any company to comply with this obligation. AIP shall, under no circumstances, be liable for any direct, indirect, incidental, special, punitive or consequential damages that may result from the use of this Site, including, without limitation, use or reliance upon any information contained on this Site, interruptions, errors, defects, omissions non-delivery of information, disclosure of communications or any other failure of performance of any kind.


By listing employment opportunities on this Site, Employer acknowledges that Employer bears sole responsibility for any claim or any sort arising from this job posting or relating in any way thereto, including but not limited to claims arising from the hiring or employment practices of Employer. Employer agrees to indemnify, defend, and hold harmless AIP, its members, directors, and employees and hold them harmless from any cost, claim, liability or expenses (including reasonable attorneys' fees and related costs) arising out of or relating in any manner to your (i) violation, or alleged violation, of this agreement or (ii) use of the Site. US federal government facilities posting are exempt from indemnifying the Site.


Employer agrees to release AIP, its members, directors, and employees from all claims, causes of action, lawsuits, liability, damages or other responsibility, known and unknown, anticipated or unanticipated, from the beginning of time until the present, arising out of your use of any AIP website or the content contained therein. If you are a resident of California, you hereby agree to waive section 1542 of the California Civil Code which provides as follows: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor."


AIP may modify these conditions, and your use of the Site after AIP publishes changes to these conditions and your use of the Site thereafter constitutes acceptance of the revised conditions.


AIP does not represent that the content of any of its websites may be lawfully accessed from countries outside the United States or by foreign nationals wherever located. Access to the content of AIP's websites may be illegal when accessed by certain persons or in certain countries. If Employer accesses the Site outside the United States or if Employer is a foreign national, Employer accesses the Site at Employer's own risk and is solely responsible for compliance with the laws of any other countries that might be applicable to Employer.


These conditions shall be governed by and in accordance with laws of Maryland. Employer agrees that any action at law or in equity arising out of or relating in any manner to the Site or these conditions shall be filed only in the courts located in Maryland and that Employer submits to the exclusive personal jurisdiction of such courts for all purposes hereunder. Unless otherwise noted, US federal government facilities are governed by federal legal statutes.


If any of these conditions shall be determined to be unlawful, against public policy or void for any reason, it is agreed such provision shall be deemed severed from the rest of the conditions and shall not be made a part of this agreement, while the remainder of the agreement remains in full force and effect.


This agreement represents the entire agreement between Employer and AIP relating to the subject matter of the foregoing and cannot be modified except as provided for hereinabove or in writing signed by an authorized representative of AIP.
